GoDaddy - Offline Payments Terms & Conditions
These Offline Payments Terms and Conditions (the “Offline Terms”) are entered into by and between GoDaddy Payments, LLC (for any payment services in the United States), and GoDaddy Payment Services Canada, LLC Canada (for any payment services in the Canada) (collectively "GoDaddy Commerce") and you, and is made effective as of the date of your use of the GoDaddy Commerce offline payments feature ("Offline Payments") or the date of electronic acceptance. These Offline Terms (i) set forth the general terms and conditions under which we provide you with access to Offline Payments, and your use of Offline Payments and (ii) incorporates the GoDaddy Universal Terms of Service Agreement and the Commerce Services Agreement (and any successor versions) (each a "Services Agreement"). Services Agreements and additional policies apply to certain Services and are in addition to (not in lieu of) these Offline Terms. In the event of a conflict between the provisions of a Services Agreement and the provisions of these Offline Terms the provisions of the applicable Services Agreement shall control.
The terms “we”, “us” or “our” shall refer to GoDaddy Commerce. The terms “you”, “your”, “User” or “customer” shall refer to any individual or entity who accepts these Offline Terms, has access to your account or uses the Services. Nothing in these Offline Terms shall be deemed to confer any third-party rights or benefits.
By accessing Offline Payments, you accept the terms and conditions of these Offline Terms. Do not continue to use Offline Payments if you do not agree to comply with these Offline Terms.
1. Terms and ConditionsWith Offline Payments, you can accept credit cards, debit cards and cash payments when your internet service is temporarily unavailable or your Wi-Fi connection from the Poynt Point of Sale Device has been lost. Offline Payments are processed automatically when your device regains connectivity. By enabling Offline Payments, you agree that:
- You, as the user, assume all decline risk of the Offline Payments transaction;
- You acknowledge and agree that if the issuer declines the Offline Payments transaction, there’s no way to recover the funds, and you might not receive payment from the customer for goods or services already provided;
- Offline Payments only supports credit card, debit card and cash transactions. Other transactions can only be processed while connected to the internet; and
- If you have pending Offline Payments transactions, you must process these payments by reconnecting your device to the Internet.
The following are our recommendations for how to ensure a successful Offline Payments transaction and is for information purposes only. Before taking an Offline Payment, we recommend that you verify the name of the cardholder as well as the expiration date to ensure it's a valid credit or debit card.
- You'll also want to be sure to obtain a signature for every Offline Payments transaction and verify the signature on the screen matches the signature on the back of the payment card.
- If the card is not signed, ask your customer for a government-issued ID and to sign the card. Looking at their ID, match the signature to the signature on the payment card.
- While you can't require your customer to provide an ID, and requesting an ID doesn't change your liability for chargebacks, unsigned cards are invalid and should not be accepted.
- Remember, if a payment card is declined, GoDaddy Commerce is unable to provide buyer contact information.
To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to Offline Payments, and the Services. Nothing in this disclaimer will
- limit or exclude our or your liability for death or personal injury;
- limit or exclude our or your liability for fraud or fraudulent misrepresentation;
- limit any of our or your liabilities in any way that is not permitted under applicable law; or
- exclude any of our or your liabilities that may not be excluded under applicable law.
The limitations and prohibitions of liability set in this section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty, except to the extent expressly provided otherwise in this disclaimer.
4. Changes to Offline TermsGoDaddy Commerce reserves the right, at its sole discretion, to modify or replace these terms at any time. Your use of Offline Payments, or the Services after such replacements or modifications have been made shall constitute your acceptance of this Agreement as last revised. If you do not agree to be bound by this Agreement as last revised, do not use (or continue to use) Offline Payments or the Services.
