GoDaddy - Ketentuan Pengguaan AI

1. Gambaran umum

Ketentuan penggunaan ini ("Ketentuan Penggunaan AI") mengatur penggunaan Anda atas Layanan apa pun yang terdiri dari produk, fitur, bot, agen, layanan, dan/atau alat AI ("Layanan AI") yang ditawarkan oleh GoDaddy.com, LLC atau afiliasinya (“GoDaddy”). Penggunaan Anda atas Layanan AI tunduk pada ketentuan GoDaddy yaitu Perjanjian Ketentuan Layanan Universal, Pemberitahuan Privasi Global, Adendum Pemrosesan Data, dan semua ketentuan atau ketentuan khusus produk yang berlaku untuk situs tempat Anda menggunakan Layanan AI kami (secara kolektif, dengan Ketentuan Penggunaan AI, "Perjanjian"). Istilah berhuruf kapital yang digunakan, tetapi tidak dijelaskan, pada Ketentuan Penggunaan AI ini, memiliki makna sebagaimana ditetapkan di bagian lain dalam Perjanjian.

2. Konten secara Umum

Anda dapat memberikan input ke Layanan Al ("Input") dan menerima atau menggunakan output dari Layanan Al berdasarkan Input ("Output"). Input mencakup, tanpa batasan, semua umpan balik, instruksi, informasi, atau prompt yang Anda berikan sebagai bagian dari Layanan AI. Input dan Output secara kolektif disebut "Konten". Anda bertanggung jawab atas semua Konten, termasuk memastikan bahwa Konten tersebut tidak melanggar hukum yang berlaku atau Ketentuan Penggunaan AI ini atau ketentuan lain dalam Perjanjian atau melanggar hak kekayaan intelektual, publisitas, privasi, atau hak paten pihak ketiga lainnya.
GoDaddy secara eksklusif memiliki semua hak, kepemilikan, dan kepentingan dalam dan terhadap Layanan AI serta Layanan lainnya (sebagaimana dijelaskan dalam Perjanjian Ketentuan Layanan Universal) dan tidak ada yang terkandung dalam Ketentuan Penggunaan AI ini yang akan dianggap memberi Anda hak paten dalam Layanan AI.
Antara Anda dan GoDaddy, dan jika diizinkan oleh hukum yang berlaku, Anda (a) mempertahankan hak kepemilikan Anda atas Input dan (b) memiliki Output. Jika diizinkan oleh hukum yang berlaku, kami dengan ini mengalihkan kepada Anda semua hak, kepemilikan, dan kepentingan kami, jika ada, atas Output.
Kami dapat menggunakan Konten untuk menyediakan, memelihara, mengembangkan, dan meningkatkan Layanan kami, mematuhi hukum yang berlaku, menegakkan ketentuan dan kebijakan kami, memasarkan dan mengiklankan Layanan kami, serta menjaga keamanan Layanan kami. 
Anda menyatakan dan menjamin bahwa Anda sepenuhnya memiliki atau mempunyai semua hak, lisensi, persetujuan, otorisasi, dan izin yang diperlukan untuk semua materi yang digunakan sebagai Input.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Penghentian dan Penangguhan

Kami berhak menangguhkan atau menghentikan akses Anda ke Layanan AI atau menghapus akun Anda atas kebijakan kami sendiri.

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Penafian

ANDA SECARA KHUSUS MENGAKUI DAN MENYETUJUI BAHWA OUTPUT DARI LAYANAN AI BELUM DITINJAU TERKAIT KEAKURATAN, BIAS, KEJELASAN, ATAU IZIN HAK KEKAYAAN INTELEKTUAL. GoDaddy TIDAK MEMBERIKAN PERNYATAAN, JAMINAN, ATAU GARANSI ATAS KEAKURATAN, KEANDALAN, ATAU PERFORMA LAYANAN AI YANG BEBAS DARI KESALAHAN, TERMASUK (TANPA BATASAN) APAKAH OUTPUT YANG DIHASILKAN DAPAT MELANGGAR, MENYALAHGUNAKAN, ATAU MELANGGAR HAK KEKAYAAN INTELEKTUAL PIHAK KETIGA MANA PUN.

ANDA MENERIMA DAN MENYETUJUI BAHWA SETIAP PENGGUNAAN OUTPUT DARI LAYANAN AI KAMI MERUPAKAN RISIKO ANDA SENDIRI DAN ANDA TIDAK AKAN MENGANDALKAN OUTPUT SEBAGAI SATU-SATUNYA SUMBER KEBENARAN ATAU INFORMASI FAKTUAL, ATAU SEBAGAI PENGGANTI SARAN PROFESIONAL.

ANDA HARUS MENCARI SARAN PROFESIONAL INDEPENDEN SEBELUM MENGANDALKAN OUTPUT APA PUN YANG DIHASILKAN OLEH LAYANAN AI.

10. Batasan Tanggung Jawab

GoDaddy, PEJABAT, DIREKTUR, KARYAWAN, AGEN, ATAU PENYEDIA LAYANAN PIHAK KETIGA MANA PUN, TIDAK BERTANGGUNG JAWAB KEPADA ANDA ATAU ORANG ATAU ENTITAS LAIN MANA PUN ATAS KERUGIAN LANGSUNG, TIDAK LANGSUNG, TIDAK DISENGAJA, KHUSUS, HUKUMAN, ATAU KONSEKUENSIAL, TERMASUK KERUGIAN APA PUN YANG MUNGKIN DIAKIBATKAN OLEH OUTPUT YANG DIHASILKAN MENGGUNAKAN LAYANAN AI.

SELAIN ITU, ANDA SECARA KHUSUS MENGAKUI DAN MENYETUJUI BAHWA TOTAL JUMLAH TANGGUNG JAWAB GoDaddy SEHUBUNGAN DENGAN LAYANAN AI ATAU OUTPUT YANG DIHASILKAN MENGGUNAKAN LAYANAN AI TIDAK LEBIH DARI 10.000,00 DOLAR AS.

BATASAN TANGGUNG JAWAB YANG DISAMPAIKAN SEBELUMNYA AKAN BERLAKU SELAMA DIIZINKAN OLEH HUKUM, DAN TETAP BERLAKU MESKIPUN TERJADI PENGHENTIAN ATAU BERAKHIRNYA PERJANJIAN INI ATAU PENGGUNAAN ANDA ATAS SITUS INI, LAYANAN AI, ATAU LAYANAN APA PUN YANG DITEMUKAN PADA SITUS INI.

Versi terjemahan dari perjanjian dan kebijakan hukum disediakan semata-mata untuk memudahkan Anda dalam membaca dan memahami versi bahasa Inggris. Tujuan penyediaan terjemahan perjanjian dan kebijakan hukum bukan untuk membuat perjanjian yang terikat secara hukum dan bukan sebagai pengganti validitas hukum dari versi bahasa Inggris. Dalam kasus sengketa atau konflik, perjanjian dan kebijakan hukum versi bahasa Inggris dalam hal apa pun hukum mengatur hubungan dan diutamakan atas ketentuan dalam bahasa lain.
