GoDaddy - Términos de uso de IA

1. Información general

Las presentes condiciones de uso (“Condiciones de uso de IA”) rigen el uso que usted haga de cualquier servicio que consista en productos, funciones, bots, agentes, servicios y/o herramientas de IA (“Servicios de IA”) ofrecidos por GoDaddy.com, LLC o sus afiliados (“GoDaddy”). Además, el uso que haga de los Servicios de IA está sujeto a los Términos universales del servicio, el Aviso de privacidad global, el Anexo sobre el tratamiento de datos de GoDaddy y todas las condiciones específicas aplicables al producto o cualquier condición aplicable al sitio a través del cual utilice nuestros Servicios de IA (en conjunto, junto con las Condiciones de uso de la IA, el “Acuerdo”). Los términos en mayúsculas utilizados, pero no definidos, en estas Condiciones de uso de IA tienen el significado que se les da en otras partes del Acuerdo.

2. Contenido en general

Usted puede proporcionar información a los Servicios de IA (“Entradas”) y recibir o usar resultados de los Servicios de IA con base en las Entradas (“Resultados”). La información introducida incluye, sin limitación, todos los comentarios, instrucciones, información o indicaciones que usted proporcione como parte de los Servicios de IA. Las Entradas y los Resultados son, en conjunto, el “Contenido”. Usted es responsable por todo el Contenido, lo que incluye garantizar que no infrinja ninguna ley aplicable ni las presentes Condiciones de uso de IA u otras condiciones del Acuerdo, ni que vulnere los derechos de propiedad intelectual, publicidad, privacidad u otros derechos de propiedad de terceros.
GoDaddy es el propietario exclusivo de todos los derechos, títulos e intereses sobre los Servicios de IA y otros Servicios (tal y como se definen en el Acuerdo de términos universales del servicio) y nada de lo contenido en estas Condiciones de uso de IA se considerará como una concesión de derechos de propiedad sobre los Servicios de IA.
Entre usted y GoDaddy, y en la medida en que lo permita la legislación aplicable, usted (a) conserva sus derechos de propiedad sobre la Entrada y (b) es propietario de los Resultados. En la medida en que lo permita la legislación aplicable, por la presente le cedemos todos nuestros derechos, títulos e intereses, si los hubiera, sobre los Resultados.
Podemos utilizar el Contenido para proporcionar, mantener, desarrollar y mejorar nuestros Servicios, cumplir con la legislación aplicable, hacer cumplir nuestros términos y políticas, comercializar y publicitar nuestros Servicios y mantener la seguridad de los mismos. 
Usted declara y garantiza que es el propietario total y con exclusión o que dispone de todos los derechos, licencias, consentimientos, autorizaciones y permisos necesarios para todos los materiales utilizados como Entrada.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Cancelación y suspensión

Nos reservamos el derecho de suspender o cancelar su acceso a nuestros Servicios de IA o eliminar su cuenta a nuestra entera discreción.

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Avisos legales

RECONOCE Y ACEPTA ESPECÍFICAMENTE QUE LOS RESULTADOS DE LOS SERVICIOS DE IA NO SE REVISARON PARA CERTIFICAR SU NIVEL DE PRECISIÓN, SESGO, CAPACIDAD DE EXPLICACIÓN O AUTORIZACIÓN DE DERECHOS DE PROPIEDAD INTELECTUAL. GoDaddy NO FORMULA DECLARACIÓN O GARANTÍA ALGUNA EN REFERENCIA A LA PRECISIÓN, FIABILIDAD O RENDIMIENTO LIBRE DE ERRORES DE LOS SERVICIOS DE IA, INCLUYENDO (SIN LIMITACIONES) SI LOS RESULTADOS, POSIBLEMENTE, INFRINGEN, SE APROPIAN DE FORMA INADECUADA O VIOLAN CUALQUIER DERECHO DE PROPIEDAD INTELECTUAL DE TERCEROS.

USTED ACEPTA QUE CUALQUIER USO DE LOS RESULTADOS DE NUESTRO SERVICIO DE IA ES BAJO SU PROPIO RIESGO Y QUE NO DEPENDERÁ DE LOS RESULTADOS COMO UNA ÚNICA FUENTE DE INFORMACIÓN VERDADERA O FACTUAL, O COMO UN SUSTITUTO DEL ASESORAMIENTO PROFESIONAL.

RECOMENDAMOS ASESORARSE CON UN PROFESIONAL INDEPENDIENTE ANTES DE CONFIAR EN LOS RESULTADOS GENERADOS POR LOS SERVICIOS DE IA.

10. Limitación de la responsabilidad civil

BAJO NINGUNA CIRCUNSTANCIA GoDaddy, SUS OFICIALES, DIRECTORES, EMPLEADOS, AGENTES O PROVEEDORES DE SERVICIOS DE TERCEROS SERÁN RESPONSABLES ANTE USTED O CUALQUIER OTRA PERSONA O ENTIDAD POR CUALQUIER DAÑO DIRECTO, INDIRECTO, INCIDENTAL, ESPECIAL, PUNITIVO O CONSECUENTE, INCLUYENDO LOS PROVOCADOS POR CUALQUIER RESULTADO CREADO MEDIANTE EL USO DE LOS SERVICIOS DE IA.

ADEMÁS, USTED RECONOCE Y ACEPTA ESPECÍFICAMENTE QUE EN NINGÚN CASO LA RESPONSABILIDAD TOTAL DE GoDaddy EN RELACIÓN CON LOS SERVICIOS DE IA O CUALQUIER RESULTADO CREADO UTILIZANDO LOS SERVICIOS DE IA EXCEDERÁ LOS US$ 10,000.00.

LA ANTERIOR LIMITACIÓN DE RESPONSABILIDAD SE APLICARÁ AL MÁXIMO PERMITIDO POR LA LEY Y SOBREVIVIRÁ A CUALQUIER RESCISIÓN O EXPIRACIÓN DE ESTE CONTRATO O DEL USO QUE USTED HAGA DE ESTE SITIO, DE LOS SERVICIOS DE IA Y DE CUALQUIER OTRO SERVICIO QUE ALLÍ SE ENCUENTRA.

Las versiones traducidas de los contratos y las políticas legales se proporcionan únicamente a modo de la comodidad de facilitar la lectura y el entendimiento de las versiones en inglés. El objetivo de proporcionar las traducciones de los contratos y las políticas legales no es crear un contrato jurídicamente vinculante y no ser un substituto para la validez legal de las versiones en inglés. En caso de que exista alguna disputa o conflicto, las versiones en inglés de los contratos y las políticas legales en cualquier caso rigen nuestra relación y prevalecerán sobre los términos en cualquier otro lenguaje.
