GoDaddy - GOOD AS GOLD TERMS OF SERVICE AGREEMENT
This Good As Gold Terms of Service Agreement (this “Agreement”) is entered into by and between you (“Customer,” “you,” or “your”) and GoDaddy.com, LLC and/or its affiliates (“GoDaddy”, “we”, “our”, or "Us") and governs our respective rights and obligations.
This Agreement sets forth the terms and conditions of your use of GoDaddy’s prepaid services program that allows you to transfer funds into an account with GoDaddy ("Good As Gold Account"), and then use said funds to purchase GoDaddy products and services, including without limitation domain names and related services, hosting, email, software, and applications (the “Good as Gold Prepaid Services”).
By accessing or using the Good As Gold Prepaid Services, you agree to the terms of this Agreement, and GoDaddy’s Universal Terms of Service Agreement as well as all other applicable terms, conditions, limitations, and requirements on the GoDaddy website, all of which (as changed over time) are incorporated into this Agreement. If you do not agree to this Agreement, you must not access or use the Good As Gold Prepaid Services.
2. SERVICE DETAILSYou acknowledge funds transferred into your Good As Gold Account will be held in an account by GoDaddy, which will not accrue or pay interest for your benefit. To the extent interest, if any, may accrue, you understand and agree GoDaddy shall be entitled to receive and keep any such amounts.
You acknowledge and agree that (i) all transactions using the Good As Gold Prepaid Services will be conducted in U.S. Dollars and (ii) funds held in a Good As Gold Account will also be held in U.S. Dollars.
You can verify the funds in your Good As Gold Account at any time through your Account.
3. FUNDING AND WIRE TRANSFER DETAILSYour Good As Gold Account must be funded on an initial basis with no less than funds equivalent to one hundred ($100.00) U.S. dollars.
Additional funds may be added to your Good As Gold Account at any time.
You hereby acknowledge that Good As Gold Account balances of two thousand dollars ($2000) or more require GoDaddy to conduct know-your-customer verification actions (“KYC”). You hereby agree to fully cooperate with such actions and to provide GoDaddy with timely and accurate information in response to any KYC or other requests for information. For clarity, we reserve the right to take any action in our sole discretion as we deem necessary including without limitation to close Good As Gold Accounts that do not pass our KYC checks.
When you fund your Good As Gold Account, you must clearly indicate the GoDaddy Customer number you would like funds applied to. Your failure to clearly indicate such information may result in (i) the non-application of funds, (ii) the misapplication of funds, and/or (iii) delays in your ability to purchase GoDaddy products and services with your Good As Gold Account, and GoDaddy expressly disclaims any liability or responsibility for the same.
Wire Transfer Details. Wire transfers may be initiated in foreign currency to fund your Good As Gold Account, however the currency of the GoDaddy bank account is U.S. Dollars. Foreign currency wires will be automatically converted and deposited in U.S. Dollars. Please note that exchange rate fees may apply.
You (i) are responsible for all fees charged by your bank, intermediary banks or GoDaddy’s bank(s) including without limitation all forms of wire transfer fees, both incoming and outgoing, associated with your Good As Gold Account and (ii) acknowledge that these fees may reduce the amount of the money received by GoDaddy’s bank and subsequently funded into your Good As Gold Account. Further, you hereby expressly authorize GoDaddy to charge a twenty-dollar ($20.00) service fee (“Service Fee”) in connection with the termination of your Good As Gold Account. All Service Fees are subject to change at any time, and such changes shall be posted online and effective immediately without need for further notice to you.
4. USE OF GOOD AS GOLD PREPAID SERVICESUse of funds in your Good As Gold Account can only be made through the GoDaddy purchase process at GoDaddy’s website. Purchases made with your Good As Gold Account may not be made (i) unless there are sufficient, available funds in your Good As Gold Account at the time of purchase to cover the entire purchase amount, including any related fees as set forth herein or in other relevant agreements and (ii) in combination with In-Store Credits.
For security purposes, you should keep your GoDaddy account access information in a secure location and take precautions to prevent others from gaining access to your Username and password. You agree you will be responsible for all activity in your Good As Gold Account, whether initiated by you, by others on your behalf, or by any other means. GoDaddy specifically disclaims liability for any activity in your Good As Gold Account, whether authorized by you or not.
5. UNCLAIMED PROPERTY
Please be advised that if a customer has an outstanding account balance (a credit positive balance) whether in In-Store Credits, a Good As Gold Account or otherwise, that has been inactive for three (3) years or more for any reason , then GoDaddy shall turn over such account balance to the applicable U.S. state in accordance with state law.
The term of this Agreement shall continue in full force and effect as long as you have any Good As Gold Accounts with GoDaddy.
GoDaddy explicitly reserves the right to terminate your Good As Gold Account if we reasonably believe that (i) the Good As Gold Account is connected in any way to fraud, excessive charges or illegal activity (ii) terminating the Good As Gold Account is necessary to protect our interests. GoDaddy also may discontinue the Good As Gold Prepaid Services at any time in its sole discretion.
In the event this Agreement or your Good as Gold Account is terminated, or you request a refund of an amount in your Good as Gold Account, the balance in your Good As Gold Account will be refunded, net the Service Fee. Such refund may take up to eight (8) weeks or more to reach you. For clarity, refunds will be limited to current amount held in a Good As Gold Account as of the date of the refund request.
7. TITLES AND HEADINGS; INDEPENDENT COVENANTS; SEVERABILITY
The titles and headings of this Agreement are for convenience and ease of reference only and shall not be utilized in any way to construe or interpret the agreement of the parties as otherwise set forth herein. Each covenant and agreement in this Agreement shall be construed for all purposes to be a separate and independent covenant or agreement. If a court of competent jurisdiction holds any provision (or portion of a provision) of this Agreement to be illegal, invalid, or otherwise unenforceable, the remaining provisions (or portions of provisions) of this Agreement shall not be affected thereby and shall be found to be valid and enforceable to the fullest extent permitted by law.
Capitalized terms used but not defined herein shall have the meanings ascribed to them in the Universal Terms of Service Agreement. In the event there is a conflict between the provisions of this Agreement and the provisions of the Universal Terms of Service Agreement, the provisions of this Agreement shall control.
We may update or revise this Agreement periodically. Material changes will be communicated to you via email or platform notifications. Your continued use of the Good As Gold Prepaid Services after changes take effect constitutes acceptance of the updated or revised Agreement.
