GoDaddy – Warunki użytkowania SI

1. Informacje ogólne

Niniejsze warunki użytkowania („Warunki użytkowania SI”) regulują korzystanie przez Użytkownika z wszelkich Usług obejmujących produkty, funkcje, boty, agentów, usługi i/lub narzędzia SI („Usługi SI”) oferowane przez firmę GoDaddy.com, LLC lub jej Partnerów („GoDaddy”). Ponadto, niniejsze warunki użytkowania Usług SI podlegają postanowieniom Regulaminu ogólnego GoDaddy, Globalnych zasad ochrony prywatności danych, Aneksu dotyczącego przetwarzania danych i wszystkich obowiązujących warunków dotyczących konkretnych produktów lub wszelkich warunków mających zastosowanie do witryny, za pośrednictwem której Użytkownik korzysta z naszych usług SI (łącznie z Warunkami użytkowania SI, zwanymi dalej „Umową”). Terminy zapisane wielką literą, które nie zostały zdefiniowane w niniejszych Warunkach użytkowania SI, mają znaczenie nadane im w innej części Umowy.

2. Ogólne treści

Użytkownik może dostarczać dane wejściowe do Usług SI („Dane wejściowe”) i otrzymywać dane wyjściowe z Usług SI w oparciu o dane wejściowe („Dane wyjściowe”). Dane wejściowe obejmują między innymi wszystkie opinie, instrukcje, informacje lub podpowiedzi, które Użytkownik przekazuje w ramach usług SI. Dane wejściowe i Dane wyjściowe to łącznie „Treści”. Użytkownik ponosi odpowiedzialność za wszystkie Treści, w tym za zapewnienie, że nie naruszają one żadnych obowiązujących przepisów prawa ani niniejszych Warunków użytkowania SI lub innych warunków Umowy, ani nie naruszają praw własności intelektualnej, praw do wizerunku, prywatności lub innych praw własności osób trzecich.
GoDaddy jest wyłącznym właścicielem wszystkich praw, tytułów i udziałów w Usługach SI i innych Usługach (zgodnie z definicją zawartą w Regulaminie ogólnym) i żadne postanowienie niniejszych Warunków użytkowania SI nie może być interpretowane jako przyznanie Użytkownikowi jakichkolwiek praw własności do Usług SI.
W stosunkach między Użytkownikiem a GoDaddy oraz w zakresie dozwolonym przez obowiązujące prawo Użytkownik (a) zachowuje prawa własności do Danych wejściowych oraz (b) jest właścicielem Danych wyjściowych. W zakresie dozwolonym przez obowiązujące prawo, niniejszym przenosimy na Użytkownika wszystkie nasze prawa, tytuły i udziały, jeśli takie istnieją, w odniesieniu do Danych wyjściowych.
Możemy wykorzystywać Treści w celu świadczenia, utrzymania, rozwoju i ulepszania naszych Usług, przestrzegania obowiązujących przepisów prawa, egzekwowania naszych warunków i zasad, promowania i reklamowania naszych Usług oraz zapewnienia ich bezpieczeństwa. 
Użytkownik oświadcza i gwarantuje, że jest wyłącznym właścicielem lub posiada wszystkie niezbędne prawa, licencje, zgody, upoważnienia i pozwolenia dotyczące wszystkich materiałów wykorzystanych jako Dane wejściowe.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Wypowiedzenie i zawieszenie

Zastrzegamy sobie prawo do zawieszenia lub zakończenia dostępu Użytkownika do naszych Usług SI lub usunięcia jego konta według naszego uznania.

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Zastrzeżenia

UŻYTKOWNIK JEDNOZNACZNIE PRZYJMUJE DO WIADOMOŚCI I ZGADZA SIĘ, ŻE DANE WYJŚCIOWE USŁUG SI NIE ZOSTAŁY SPRAWDZONE POD KĄTEM DOKŁADNOŚCI, STRONNICZOŚCI, ZROZUMIAŁOŚCI LUB ZGODNOŚCI Z PRAWAMI WŁASNOŚCI INTELEKTUALNEJ. FIRMA GoDaddy NIE SKŁADA ŻADNYCH OŚWIADCZEŃ, ZAPEWNIEŃ ANI GWARANCJI DOTYCZĄCYCH DOKŁADNOŚCI, NIEZAWODNOŚCI LUB BEZBŁĘDNEGO DZIAŁANIA USŁUG SI, W TYM (BEZ OGRANICZEŃ) TEGO, CZY DANE WYJŚCIOWE MOGĄ NARUSZAĆ, NADUŻYWAĆ LUB NARUSZAĆ JAKIEKOLWIEK PRAWA WŁASNOŚCI INTELEKTUALNEJ OSÓB TRZECICH.

UŻYTKOWNIK AKCEPTUJE I ZGADZA SIĘ, ŻE WSZELKIE KORZYSTANIE Z DANYCH WYJŚCIOWYCH Z NASZEJ USŁUGI SI ODBYWA SIĘ NA JEGO WYŁĄCZNE RYZYKO I NIE BĘDZIE POLEGAĆ NA DANYCH WYJŚCIOWYCH JAKO JEDYNYM ŹRÓDLE PRAWDY LUB FAKTYCZNYCH INFORMACJI, ANI JAKO SUBSTYTUCIE PROFESJONALNEJ PORADY.

PRZED SKORZYSTANIEM Z AUTOMATYCZNIE WYGENEROWANYCH DANYCH WYJŚCIOWYCH NALEŻY ZASIĘGNĄĆ NIEZALEŻNEJ PROFESJONALNEJ PORADY.

10. Ograniczenie odpowiedzialności

W ŻADNYM WYPADKU FIRMA GoDaddy, JEJ CZŁONKOWIE ZARZĄDU, DYREKTORZY, PRACOWNICY, AGENCI ANI ŻADNI ZEWNĘTRZNI DOSTAWCY USŁUG NIE PONOSZĄ ODPOWIEDZIALNOŚCI WOBEC UŻYTKOWNIKA ANI ŻADNEJ INNEJ OSOBY LUB PODMIOTU ZA JAKIEKOLWIEK SZKODY BEZPOŚREDNIE, POŚREDNIE, PRZYPADKOWE, SPECJALNE, KARNE LUB WTÓRNE, W TYM SZKODY, KTÓRE MOGĄ WYNIKAĆ Z JAKICHKOLWIEK DANYCH WYJŚCIOWYCH UTWORZONYCH PRZY UŻYCIU USŁUG SI.

PONADTO UŻYTKOWNIK W SZCZEGÓLNOŚCI PRZYJMUJE DO WIADOMOŚCI I POTWIERDZA, ŻE W ŻADNYM PRZYPADKU CAŁKOWITA ŁĄCZNA ODPOWIEDZIALNOŚĆ FINANSOWA FIRMY GoDaddy W ZWIĄZKU Z USŁUGAMI SI LUB JAKIMIKOLWIEK DANYMI WYJŚCIOWYMI STWORZONYMI PRZY UŻYCIU USŁUG SI NIE PRZEKROCZY KWOTY 10 000,00 DOLARÓW AMERYKAŃSKICH.

POWYŻSZE OGRANICZENIE ODPOWIEDZIALNOŚCI OBOWIĄZUJE W NAJSZERSZYM ZAKRESIE DOZWOLONYM PRZEZ PRAWO I BĘDZIE OBOWIĄZYWAĆ RÓWNIEŻ PO ROZWIĄZANIU LUB WYGAŚNIĘCIU NINIEJSZEJ UMOWY LUB ZAPRZESTANIU KORZYSTANIA PRZEZ UŻYTKOWNIKA Z TEJ STRONY, USŁUG SI LUB INNYCH, KTÓRE SĄ NA NIEJ DOSTĘPNE.

Przetłumaczone wersje umów prawnych i zasad są udostępniane wyłącznie w celu ułatwienia czytania i zrozumienia wersji angielskojęzycznych. Przetłumaczone wersje umów prawnych i zasad nie stanowią prawnie wiążącej umowy i nie mają pierwszeństwa przed wersjami angielskojęzycznymi. W razie sporów lub konfliktów wersje angielskojęzyczne umów prawnych i zasad w każdym przypadku określają nasze relacje oraz mają pierwszeństwo przed innymi wersjami językowymi.
