GoDaddy - Termini di utilizzo IA

1. Panoramica

I presenti Termini di utilizzo ("Termini di utilizzo dell'IA") disciplinano l'utilizzo da parte dell'Utente di qualsiasi Servizio costituito da prodotti, funzionalità, bot, agenti, servizi e/o strumenti di IA ("Servizi di IA") offerti da GoDaddy.com, LLC o dalle sue società affiliate ("GoDaddy"). Inoltre, l'utilizzo dei Servizi di IA da parte dell'Utente è soggetto all'Accordo per i termini di utilizzo universali, all'Informativa globale sulla privacy e alle Clausole integrative sul trattamento dei dati di GoDaddy, nonché a tutti i termini specifici di prodotto applicabili o a qualsiasi termine applicabile al sito tramite il quale l'Utente utilizza i nostri Servizi di IA (collettivamente, insieme ai Termini di utilizzo dell'IA, il "Contratto"). I termini con l'iniziale maiuscola utilizzati, ma non definiti, nei presenti Termini di utilizzo dell'IA, hanno il significato loro attribuito altrove nel Contratto.

2. Contenuti in generale

L'utente può fornire input ai Servizi di IA ("Input") e ricevere o utilizzare output dai Servizi di IA basati sull'Input ("Output"). L'Input include, a titolo esemplificativo ma non esaustivo, tutti i feedback, le istruzioni, le informazioni o gli impulsi che l'Utente fornisce nell'ambito dei Servizi di IA. L'Input e l'Output sono collettivamente "Contenuti". L'Utente è responsabile di tutti i Contenuti, e deve garantire che non violino alcuna legge applicabile, i presenti Termini di utilizzo dell'IA o altri termini del Contratto, né che infringano i diritti di proprietà intellettuale, di immagine, di privacy o altri diritti proprietari di terzi.
GoDaddy è l'unica ed esclusiva titolare di tutti i diritti, titoli e interessi relativi ai Servizi di IA e agli altri Servizi (come definiti nel Contratto sui termini di servizio universali) e nulla di quanto contenuto nei presenti Termini di utilizzo dell'IA potrà essere considerato come una concessione all'Utente di alcun diritto proprietario sui Servizi di IA.
Nei rapporti tra l'Utente e GoDaddy, e nella misura consentita dalla legge applicabile, l'Utente (a) mantiene i propri diritti di proprietà sull'Input ed (b) è proprietario dell'Output. Nella misura consentita dalla legge applicabile, con il presente documento Le cediamo tutti i nostri diritti, titoli e interessi, se presenti, relativi all'Output.
Possiamo utilizzare i Contenuti per fornire, mantenere, sviluppare e migliorare i nostri Servizi, rispettare la legge applicabile, far rispettare i nostri termini e le nostre policy, commercializzare e pubblicizzare i nostri Servizi e garantire la sicurezza dei nostri Servizi. 
L'Utente dichiara e garantisce di essere il pieno ed esclusivo proprietario o di possedere tutti i diritti, le licenze, i consensi, le autorizzazioni e i permessi necessari per tutti i materiali utilizzati come Input.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Risoluzione e sospensione

Ci riserviamo il diritto di sospendere o interrompere l'accesso dell'utente ai nostri Servizi di IA o di eliminare l'account dell'utente a nostra esclusiva discrezione.

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Dichiarazioni di non responsabilità

L'UTENTE RICONOSCE E ACCETTA SPECIFICAMENTE CHE I RISULTATI DEI SERVIZI DI INTELLIGENZA ARTIFICIALE NON SONO STATI ESAMINATI PER VERIFICARNE L'ACCURATEZZA, LA PARZIALITÀ, LA SPIEGABILITÀ O L'AUTORIZZAZIONE DEI DIRITTI DI PROPRIETÀ INTELLETTUALE. GoDaddy NON RILASCIA ALCUNA DICHIARAZIONE O GARANZIA IN MERITO ALL'ACCURATEZZA, ALL'AFFIDABILITÀ, O A PRESTAZIONI SENZA ERRORI DEI SERVIZI DI INTELLIGENZA ARTIFICIALE, TRA CUI (A TITOTOLO ESEMPLIFICATIVO MA NON ESAUSTIVO) L'EVENTUALITÀ CHE GLI OUTPUT POSSANO TRASGREDIRE, VIOLARE O APPROPRIASI INDEBITAMENTE DEI DIRITTI DI PROPRIETÀ INTELLETTUALE DI TERZE PARTI

L'UTENTE ACCETTA E CONCORDA CHE QUALSIASI UTILIZZO DEI RISULTATI DEL NOSTRO SERVIZIO DI INTELLIGENZA ARTIFICIALE È A SUO ESCLUSIVO RISCHIO E NON FARÀ AFFIDAMENTO SUI RISULTATI COME UNICA FONTE DI VERITÀ O INFORMAZIONI FATTUALI, O COME SOSTITUTO DI UNA CONSULENZA PROFESSIONALE.

È CONSIGLIABILE RIVOLGERSI A UN CONSULENTE LEGALE PRIMA DI FARE AFFIDAMENTO AL CONTENUTO GENERATO DAI SERVIZI DI IA.

10. Limitazione di responsabilità

IN NESSUN CASO GoDaddy, I SUOI FUNZIONARI, DIRETTORI, DIPENDENTI, AGENTI O SERVICE PROVIDER DI TERZE PARTI, SARANNO RESPONSABILI NEI CONFRONTI DELL'UTENTE O DI ALTRI ENTI O PERSONE PER DANNI DIRETTI, INDIRETTI, INCIDENTALI, SPECIALI, PUNITIVI O CONSEQUENZIALI, COMPRESI QUELLI CHE POTREBBERO DERIVARE DA OUTPUT CREATI UTILIZZANDO I SERVIZI IA.

INOLTRE, L'UTENTE RICONOSCE E ACCETTA SPECIFICAMENTE CHE IN NESSUN CASO LA RESPONSABILITÀ TOTALE COMPLESSIVA DI GoDaddy IN RELAZIONE AI SERVIZI DI IA O A QUALSIASI OUTPUT CREATO UTILIZZANDO I SERVIZI DI IA POTRÀ SUPERARE I 10.000,00 DOLLARI STATUNITENSI.

LA PRECEDENTE LIMITAZIONE DI RESPONSABILITÀ SARÀ APPLICATA NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE E RESTERÀ VALIDA ANCHE DOPO LA RISOLUZIONE O LA SCADENZA DEL PRESENTE CONTRATTO, L'UTILIZZO DI QUESTO SITO, DEI SERVIZI IA O DEI SERVIZI DISPONIBILI SU QUESTO SITO.

Le versioni tradotte di accordi e informative legali vengono fornite solo al fine di facilitare la lettura e la comprensione delle versioni in inglese. La fornitura delle traduzioni di accordi e informative legali non ha come obbiettivo quello di creare un contratto legalmente vincolante, né quello di sostituire la validità legale delle versioni in inglese. In caso di controversie o conflitti, le versioni in inglese di accordi e informative legali regolano il nostro rapporto e prevarranno sui termini tradotti in altre lingue.
