GoDaddy - Gebruiksvoorwaarden AI

1. Overzicht

Deze gebruiksvoorwaarden ("AI-gebruiksvoorwaarden") regelen uw gebruik van alle Services bestaande uit AI-producten, functies, bots, agenten, services en/of tools ('AI-services') die worden aangeboden door GoDaddy.com, LLC of haar dochterondernemingen ('GoDaddy'). Bovendien is uw gebruik van AI-services onderworpen aan de GoDaddy Universele servicevoorwaarden, de Wereldwijde privacyverklaring, het Addendum Gegevensverwerking en alle van toepassing zijnde productspecifieke voorwaarden of voorwaarden die van toepassing zijn op de site waarmee u onze AI-services gebruikt (gezamenlijk, met de AI-gebruiksvoorwaarden, de 'Overeenkomst'). Termen met een hoofdletter die in deze AI-gebruiksvoorwaarden worden gebruikt, maar niet zijn gedefinieerd, hebben de betekenis die daaraan elders in de Overeenkomst is toegekend.

2. Content algemeen

U kunt invoer geven aan de AI-services ('Invoer') en uitvoer ontvangen van de AI-services op basis van de Invoer ('Uitvoer'). Invoer omvat zonder enige beperking alle feedback, instructies, informatie of prompts die u verstrekt als onderdeel van AI-services. Invoer en Uitvoer worden samen 'Content' genoemd. U bent verantwoordelijk voor alle Content en dient er tevens voor te zorgen dat deze geen toepasselijke wetgeving, deze AI-gebruiksvoorwaarden of andere voorwaarden in de Overeenkomst schendt of inbreuk maakt op de intellectuele eigendomsrechten, publiciteitsrechten, privacyrechten of andere eigendomsrechten van derden.
GoDaddy bezit exclusief alle rechten, titels en belangen in en op de AI-services en andere services (zoals gedefinieerd in de Universele servicevoorwaarden) en niets in deze AI-gebruiksvoorwaarden mag worden beschouwd als het verlenen van eigendomsrechten op de AI-services aan u.
Tussen u en GoDaddy en voor zover toegestaan door de van toepassing zijnde wetgeving, behoudt u (a) uw eigendomsrechten op de Invoer en (b) bent u eigenaar van de Uitvoer. Voor zover toegestaan door de van toepassing zijnde wetgeving, dragen wij hierbij al onze rechten, eigendomsrechten en belangen, indien van toepassing, in en op de Uitvoer aan u over.
We kunnen Content gebruiken om onze Services te leveren, onderhouden, ontwikkelen en verbeteren, om te voldoen aan de van toepassing zijnde wetgeving, om onze voorwaarden en ons beleid te handhaven, om onze Services te marketen en te adverteren en om onze Services veilig te houden. 
U verklaart en garandeert dat u de volledige en exclusieve eigenaar bent van of beschikt over alle benodigde rechten, licenties, toestemmingen, autorisaties en toestemmingen voor alle materialen die als Invoer worden gebruikt.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Beëindiging en opschorting

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Disclaimers

GoDaddy GEEFT GEEN VERKLARING, GARANTIE OF ZEKERHEID OVER DE JUISTHEID, BETROUWBAARHEID OF DE FOUTLOZE PRESTATIES VAN DE AI-SERVICES, WAARONDER (ZONDER BEPERKINGEN) OF DE UITVOER INBREUK MAAKT OP OF ONRECHTMATIG GEBRUIK MAAKT VAN INTELECTUELE-EIGENDOMSRECHTEN VAN EEN DERDE OF DEZE SCHENDT.

U ACCEPTEERT EN GAAT ERMEE AKKOORD DAT ELK GEBRUIK VAN DE UITVOER VAN ONZE AI-SERVICE GEHEEL OP UW EIGEN RISICO IS EN DAT U DE UITVOER NIET ZULT GEBRUIKEN ALS DE ENIGE BRON VAN WAARHEID OF FEITELIJKE INFORMATIE, OF ALS VERVANGING VAN PROFESSIONEEL ADVIES.

U DIENT ONAFHANKELIJK PROFESSIONEEL ADVIES IN TE WINNEN VOORDAT U VERTROUWT OP DE UITVOER DIE AUTOMATISCH WORDT GEGENEREERD DOOR DE AI-SERVICES.

10. Beperking van aansprakelijkheid

IN GEEN ENKEL GEVAL IS GoDaddy, ZIJN HAAR FUNCTIONARISSEN, BESTUURDERS, VERTEGENWOORDIGERS OF DERDE SERVICEPROVIDERS DOOR U OF EEN ANDERE PERSOON OF ENTITEIT AANSPRAKELIJK VOOR DIRECTE, INDIRECTE, INCIDENTELE, SPECIALE, BESTRAFFENDE OF GEVOLGSCHADE, WAARONDER MOGELIJKE SCHADE ALS GEVOLG VAN DE UITVOER DIE IS GEMAAKT MET DE AI-SERVICES.

DAARNAAST GAAT U ER SPECIFIEK MEE AKKOORD DAT DE TOTALE AANSPRAKELIJKHEID VAN GoDaddy MET BETREKKING TOT DE AI-SERVICES OF ENIGE UITVOER DIE GEGENEREERD WORDT DOOR DE AI-SERVICES IN GEEN GEVAL MEER BEDRAAGT DAN $ 10.000,00 AMERIKAANSE DOLLAR.

DE BOVENSTAANDE BEPERKING VAN AANSPRAKELIJKHEID IS VAN TOEPASSING VOOR ZOVER WETTELIJK TOEGESTAAN EN BLIJFT VAN KRACHT NA EEN EVENTUELE BEËINDIGING OF AFLOOP VAN DEZE OVEREENKOMST OF UW GEBRUIK VAN DEZE SITE OF DE AI-SERVICES OF ALLE ANDERE SERVICES DIE OP DEZE SITE VOORKOMEN.

Vertaalde versies van juridische overeenkomsten en beleidsregels zijn uitsluitend bedoeld om het lezen te vergemakkelijken en het inhoudelijke begrip van de Engelse versies te vergroten. Deze vertalingen worden niet verschaft als wettelijk bindende overeenkomst en zijn geen vervanging voor de Engelse versies, die als enige wettelijk geldig zijn. In geval van een geschil of conflict zijn uitsluitend de Engelse versies van de juridische overeenkomsten en beleidsregels van toepassing en hebben deze voorrang boven de voorwaarden in elke andere taal.
