GoDaddy - Yapay Zeka Kullanım Şartları

1. Genel Bakış

Bu kullanım şartları ("AI Kullanım Şartları"), GoDaddy.com, LLC veya bağlı kuruluşları ("GoDaddy") tarafından sunulan AI ürünleri, özellikleri, botları, ajanları, hizmetleri ve/veya araçlarından ("AI Hizmetleri") oluşan tüm Hizmetlere ilişkin kullanımınızı düzenler. Ayrıca, AI Hizmetlerini kullanımınız GoDaddy şirketinin Evrensel Hizmet Koşulları Sözleşmesi, Global Gizlilik Bildirimi, Veri İşleme Eki ve tüm geçerli ürüne özgü şartlar veya AI Hizmetlerimizi kullandığınız siteye uygulanabilir tüm şartlara tabidir (AI Kullanım Şartları ile birlikte topluca “Sözleşme” olarak anılacaktır). Bu AI Kullanım Şartlarında kullanılan ancak tanımlanmayan büyük harfli terimler, Sözleşmenin başka bölümlerinde verilen anlamlara sahiptir.

2. Genel İçerik

Yapay Zeka Hizmetlerine girdi ("Girdi") sağlayabilir ve Yapay Zeka Hizmetlerinden Girdiye dayalı olarak çıktı ("Çıktı") alabilir veya kullanabilirsiniz. Girdi, AI Hizmetlerinin bir parçası olarak sağladığınız tüm geri bildirimleri, talimatları, bilgileri veya istemleri içerir, ancak bunlarla sınırlı değildir. Girdi ve Çıktı topluca "İçerik" olarak adlandırılır. Tüm İçerikten siz sorumlusunuz; içeriğin yürürlükteki yasaları, bu AI Kullanım Şartlarını veya Sözleşmedeki diğer koşulları ihlal etmediğinden ve üçüncü şahısların fikri mülkiyet, tanıtım, gizlilik veya diğer mülkiyet haklarını ihlal etmediğinden emin olmak da sizin sorumluluğunuzdadır.
GoDaddy AI Hizmetleri ve diğer Hizmetler (Evrensel Hizmet Koşulları Sözleşmesinde tanımlandığı şekilde) üzerindeki tüm hakların, ünvanların ve menfaatlerin özellikle sahibidir ve bu AI Kullanım Şartlarında yer alan hiçbir husus, size AI Hizmetleri üzerinde herhangi bir mülkiyet hakkı verdiği şeklinde yorumlanamaz.
GoDaddy ile aranızda ve geçerli yasaların izin verdiği ölçüde, (a) Giriş üzerindeki mülkiyet haklarınızı saklı tutarsınız ve (b) Çıktı size aittir. Yürürlükteki yasaların izin verdiği ölçüde, Çıktı ile ilgili tüm hak, ünvan ve menfaatlerimizi (varsa) size devrediyoruz.
Hizmetlerimizi sağlamak, sürdürmek, geliştirmek ve iyileştirmek, geçerli yasalara uymak, şartlarımızı ve politikalarımızı uygulamak, Hizmetlerimizi pazarlamak ve tanıtmak ve Hizmetlerimizi güvenli tutmak için İçeriği kullanabiliriz. 
Girdi olarak kullanılan tüm materyallerin tam ve yalnızca sahibi olduğunuzu veya gerekli tüm haklara, lisanslara, onaylara, yetkilere ve izinlere sahip olduğunuzu beyan ve garanti ediyorsunuz.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Fesih ve Askıya Alma

Kendi takdirimize bağlı olarak, AI Hizmetlerimize erişiminizi askıya alma veya sonlandırma ya da hesabınızı silme hakkını saklı tutarız.

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Sorumluluk Reddi

YAPAY ZEKA HİZMETLERİ ÇIKTILARININ DOĞRULUK, ÖNYARGI, AÇIKLANABİLİRLİK VEYA FİKRİ MÜLKİYET İZNİ AÇISINDAN İNCELENMEDİĞİNİ ÖZELLİKLE ONAYLAR VE KABUL EDERSİNİZ. GoDaddy, ÇIKTILARIN HERHANGİ BİR ÜÇÜNCÜ TARAFIN FİKRİ MÜLKİYET HAKLARINI BOZUP BOZMAYABİLECEĞİ, KÖTÜYE KULLANIP KULLANMAYABİLECEĞİ VEYA İHLAL EDİP ETMEYEBİLECEĞİ DAHİL OLMAK ÜZERE (SINIRLAMA OLMAKSIZIN), YAPAY ZEKA HİZMETLERİ’NİN DOĞRULUĞU, GÜVENİLİRLİĞİ YA DA HATASIZ ÇALIŞMASINA İLİŞKİN HİÇBİR BEYANDA BULUNMAZ VEYA GARANTİ VERMEZ.

YAPAY ZEKA HİZMETİMİZDEN ELDE EDİLEN ÇIKTILARIN HERHANGİ BİR ŞEKİLDE KULLANILMASIYLA İLGİLİ RİSKLERİN TAMAMEN SİZE AİT OLDUĞUNU VE ÇIKTILARIN TEK BİR GERÇEK VEYA OLGUSAL BİLGİ KAYNAĞI OLARAK KULLANILMAYACAĞINI VEYA PROFESYONEL TAVSİYENİN YERİNİ ALMAYACAĞINI KABUL VE BEYAN EDERSİNİZ.

YAPAY ZEKA HİZMETLERİ TARAFINDAN OLUŞTURULAN ÇIKTILARA GÜVENMEDEN ÖNCE BAĞIMSIZ PROFESYONEL TAVSİYE ALMALISINIZ.

10. Sorumluluğun Sınırlandırılması

HİÇBİR DURUMDA GoDaddy, YETKİLİLERİ, YÖNETİCİLERİ, ÇALIŞANLARI, ARACILARI VEYA ÜÇÜNCÜ TARAF HİZMET SAĞLAYICILARI; YAPAY ZEKA HİZMETLERİ KULLANILARAK OLUŞTURULAN BİR ÇIKTIDAN KAYNAKLANABİLECEK ZARARLAR DA DAHİL OLMAK ÜZERE DOĞRUDAN, DOLAYLI, ARIZİ, ÖZEL, CEZAİ VEYA BAĞLI TÜM ZARARLAR İLE İLGİLİ OLARAK SİZE, HERHANGİ BİR KİŞİYE VEYA KURULUŞA KARŞI SORUMLU OLMAYACAKTIR.

AYRICA, AI HİZMETLERİ VEYA AI HİZMETLERİ KULLANILARAK OLUŞTURULAN HERHANGİ BİR ÇIKTIYLA BAĞLANTILI OLARAK, GoDaddy TOPLAM BORCUN 10.000,00 ABD DOLARINI AŞMAYACAĞINI KABUL ETMİŞ OLURSUNUZ.

YUKARIDA BELİRTİLEN SORUMLULUK SINIRLANDIRMASI, YASALARIN İZİN VERDİĞİ EN GENİŞ ÖLÇÜDE UYGULANACAK VE BU SÖZLEŞMENİN FESHEDİLMESİ VEYA BU SİTEYİ, YAPAY ZEKA HİZMETLERİNİ VEYA BU SİTEDE BULUNAN DİĞER HİZMETLERİ KULLANIMINIZIN SONA ERMESİ DURUMUNDA DA GEÇERLİ OLMAYA DEVAM EDECEKTİR.

Yasal sözleşmelerin ve politikaların çevrilmiş sürümleri, yalnızca İngilizce sürümlerin okunmasını ve anlaşılmasını kolaylaştırmak için sunulmuştur. Yasal sözleşmelerin ve politikaların çevrilmiş sürümlerinin sunulmasının amacı, yasal olarak bağlayıcı bir sözleşme oluşturmak değildir ve İngilizce sürümler yasal olarak geçerli olacaktır. Herhangi bir anlaşmazlık veya sorun olması halinde, sizinle olan ilişkimiz için yasal sözleşmelerin ve politikaların İngilizce sürümleri geçerli olacak ve diğer dillerdeki sürümleri geçersiz kılacaktır.
