GoDaddy - Termos de Uso da IA

1. Visão geral

Estes Termos de Uso (“Termos de Uso da IA”) regem o uso de Serviços que consistam em produtos, recursos, bots, agentes, serviços e/ou ferramentas de IA (“Serviços de IA”) oferecidos pela GoDaddy.com, LLC ou suas afiliadas (“GoDaddy”). Além disso, o uso dos Serviços de IA está sujeito aos Termos de Serviço Universal da GoDaddy, à Declaração de Privacidade Global, ao Adendo de Processamento de Dados e a todos os termos específicos do produto aplicáveis, ou quaisquer termos aplicáveis ao site através do qual você utiliza nossos Serviços de IA (coletivamente, com os Termos de Uso de IA, o “Contrato”). Os termos em maiúsculas utilizados, mas não definidos, nestes Termos de Uso da IA têm os significados atribuídos em outras partes do Contrato.

2. Conteúdo Geral

Você pode fornecer informações aos Serviços de IA (“Informações”) e receber ou utilizar os resultados dos Serviços de IA com base nas Informações (“Resultados”). As informações incluem, entre outras, todos os feedbacks, instruções, informações ou solicitações que você fornece como parte dos Serviços de IA. As Informações e os Resultados constituem coletivamente o “Conteúdo”. Você é responsável por todo o Conteúdo, incluindo por garantir que ele não viole nenhuma lei vigente ou estes Termos de Uso de IA, ou outros termos do Contrato, nem infrinja quaisquer direitos de propriedade intelectual, publicidade, privacidade ou outros direitos de propriedade de terceiros.
A GoDaddy detém exclusivamente todos os direitos, títulos e interesses sobre os Serviços de IA e outros Serviços (conforme definido nos Termos de Serviço Universal), e nada contido nestes Termos de Uso da IA deve ser considerado como concessão de quaisquer direitos de propriedade sobre os Serviços de IA.
Entre você e a GoDaddy, e na medida do permitido pela lei aplicável, você (a) mantém seus direitos de propriedade sobre as Informações e (b) assume a titularidade dos Resultados. Na medida do permitido pela lei aplicável, atribuímos a você todos os nossos direitos, títulos e interesses, se houver, sobre e relativos aos Resultados.
Podemos utilizar o Conteúdo para fornecer, manter, desenvolver e melhorar nossos Serviços, cumprir a legislação aplicável, fazer cumprir nossos termos e políticas, comercializar e anunciar nossos Serviços e mantê-los seguros. 
Você declara e garante que detém total e exclusivamente ou possui todos os direitos, licenças, consentimentos, autorizações e permissões necessários para todos os materiais utilizados como Informação.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Rescisão e suspensão

Reservamo-nos o direito de suspender ou encerrar seu acesso aos nossos Serviços de IA ou excluir sua conta a nosso exclusivo critério.

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Avisos de Isenção de Responsabilidade

VOCÊ RECONHECE E CONCORDA ESPECIFICAMENTE QUE OS RESULTADOS DOS SERVIÇOS DE IA NÃO FORAM REVISADOS QUANTO À PRECISÃO, PARCIALIDADE, EXPLICABILIDADE OU LIBERAÇÃO DE DIREITOS DE PROPRIEDADE INTELECTUAL. A GoDaddy NÃO OFERECE REPRESENTAÇÃO, GARANTIA OU AVAL QUANTO À PRECISÃO, CONFIABILIDADE OU DESEMPENHO EXCEPCIONAL DOS SERVIÇOS DE IA, INCLUINDO, SEM LIMITAÇÃO, SE OS RESULTADOS PODEM INFRINGIR, APROPRIAR-SE INDEVIDAMENTE OU VIOLAR OS DIREITOS DE PROPRIEDADE INTELECTUAL DE TERCEIROS.

VOCÊ ACEITA E CONCORDA QUE QUALQUER USO DOS RESULTADOS DO NOSSO SERVIÇO DE IA É POR SUA PRÓPRIA CONTA E RISCO E VOCÊ NÃO DEVERÁ CONFIAR NOS RESULTADOS COMO ÚNICA FONTE CONFIÁVEL OU INFORMAÇÃO FACTUAL, NEM COMO SUBSTITUTOS PARA ORIENTAÇÃO PROFISSIONAL.

VOCÊ DEVE PROCURAR ORIENTAÇÃO PROFISSIONAL INDEPENDENTE ANTES DE CONFIAR EM QUALQUER RESULTADO GERADO PELOS SERVIÇOS DE IA.

10. Limitação de responsabilidade

SOB NENHUMA CIRCUNSTÂNCIA A GoDaddy, SEUS REPRESENTANTES, DIRETORES, FUNCIONÁRIOS, AGENTES OU PROVEDORES DE SERVIÇOS EXTERNOS SERÃO RESPONSÁVEIS PERANTE VOCÊ OU OUTRA PESSOA, FÍSICA OU JURÍDICA, POR DANOS DIRETOS, INDIRETOS, INCIDENTAIS, ESPECIAIS, PUNITIVOS OU RESULTANTES, INCLUINDO DANOS DECORRENTES DE RESULTADOS GERADOS USANDO OS SERVIÇOS DE IA.

ALÉM DISSO, VOCÊ RECONHECE E CONCORDA ESPECIFICAMENTE QUE, EM NENHUMA CIRCUNSTÂNCIA, A RESPONSABILIDADE TOTAL DA GoDaddy EM RELAÇÃO AOS SERVIÇOS DE IA OU A QUAISQUER RESULTADOS CRIADOS COM O USO DOS SERVIÇOS DE IA EXCEDERÁ O VALOR DE 10.000,00 DÓLARES AMERICANOS.

A LIMITAÇÃO DE RESPONSABILIDADE PRECEDENTE APLICA-SE NA MÁXIMA EXTENSÃO PERMITIDA PELA LEI E PERMANECERÁ EM VIGOR APÓS O ENCERRAMENTO OU A EXPIRAÇÃO DESTE CONTRATO OU SEU USO DESTE SITE, DOS SERVIÇOS DE IA OU DOS SERVIÇOS ENCONTRADOS NELE.
