This GoDaddy Community Terms Agreement (the “Community Terms”) is entered into by and between GoDaddy.com, LLC, a Delaware limited liability company (“GoDaddy”) and you, and is made effective as of the date of your use of this forum.

The GoDaddy Community is a place for you to connect with other GoDaddy customers to share first-hand business insights and best practices, exchange ideas, gather feedback, build relationships, troubleshoot technical issues and ultimately grow your businesses.

By using the GoDaddy Community, you agree to these Community Terms, the Universal Terms of Service and the Privacy Policy and the GoDaddy Community Guidelines (the “Terms”).

These Community Terms set forth the terms and conditions of your use of the GoDaddy Community and represents the entire agreement between you and GoDaddy concerning the subject matter hereof. If you do not agree to the Terms, please do not use the GoDaddy Community.

1. GoDaddy Community Account

In order to post within the GoDaddy Community, you must (1) have an existing GoDaddy shopper account; and (2) create a “Community Account” by following the instructions on the GoDaddy Community registration page. However, you can use the community to view existing posts without creating a Community Account. You represent and warrant to GoDaddy that all information you submit when you create your Community Account is accurate, current and complete, and that you will keep your Community Account information accurate, current and complete. If GoDaddy has reason to believe that your Community Account information is untrue, inaccurate, out-of-date or incomplete, GoDaddy reserves the right, in its sole and absolute discretion, to suspend or terminate your Community Account. You are solely responsible for the activity that occurs on your Community Account, whether authorized by you or not, and you must keep your Community Account information secure. You must notify GoDaddy immediately of any breach of security or unauthorized use of your Community Account. GoDaddy will not be liable for any loss you incur due to any unauthorized use of your Community Account. You, however, may be liable for any loss GoDaddy or others incur caused by your Community Account, whether caused by you, or by an authorized person, or by an unauthorized person. GoDaddy may reclaim or amend your username at any time. It is strictly prohibited to include any information in your profile that suggests you are a GoDaddy employee or moderator, or to otherwise pose as such an employee or moderator when using the GoDaddy Community.

2. Content, General Rules of Conduct

Any information, advice or material of any kind posted on the GoDaddy Community (“Content”) is not official support provided by GoDaddy. Please call customer support for official support with account and payment related questions. You acknowledge and agree that opinions expressed in Content are those of contributors of such Content only and may not reflect the opinions or policies of GoDaddy, its affiliates or group companies.

You shall be solely responsible for any and all of your Content or Content that is submitted through your Community Account. GoDaddy does not control and assumes no responsibility for such Content or any Content posted by other GoDaddy Community users. GoDaddy reserves the right (but undertakes no duty) to moderate Content and decide whether any item of Content is appropriate and/or complies with the Community Terms. GoDaddy may remove any item of Content and/or terminate a Community Account or your access to the GoDaddy Community for posting or publishing any material in violation of these Community Terms, as determined by GoDaddy in its sole and absolute discretion, at any time and without prior notice. GoDaddy may also terminate a your access to the GoDaddy Community if GoDaddy has reason to believe you are a repeat offender. If GoDaddy terminates your access to the GoDaddy Community, GoDaddy may, in its sole and absolute discretion, remove and destroy any Content posted by you.

We encourage all GoDaddy Community members to report any inappropriate activity or user posts in the GoDaddy Community. Inappropriate content or activity may be reported by clicking the options tab at the top right of the post and then selecting “Report Inappropriate Content.”

3. GoDaddy Community Guidelines.

The integrity and safety of our GoDaddy Community and our users means a lot to us. In order to keep the GoDaddy Community as efficient and helpful as possible, we expect you to observe the GoDaddy Community Guidelines.

4. Super User Reward Program

The GoDaddy Community includes a reward system whereby GoDaddy, in its sole discretion, may reward users based on your number of accepted solutions and overall contributions to the GoDaddy Community. You acknowledge and agree that GoDaddy’s decision with respect to any reward shall be final and binding. GoDaddy may change or remove the reward system, at its sole discretion, from time to time.

5. Term and termination

These Community Terms are made effective as of the date of your use of the GoDaddy Community or the date when you create a Community Account and will remain in effect until your Community Account is terminated. You may terminate your Community Account at any time by contacting GoDaddy at community@godaddy.com.

Without limiting any of the rights set forth elsewhere in these Community Terms, GoDaddy reserves the right to terminate or suspend your Community Account at any time if, in GoDaddy’s sole discretion, you are in contravention of any of the Community Terms. If GoDaddy terminates or suspends your Community Account for any reason, GoDaddy shall have no liability or responsibility to you. You acknowledge and agree that if your Community Account is terminated by you or GoDaddy for any reason, the Content that you have posted may be kept in the GoDaddy Community. GoDaddy may, in its sole discretion, delete your Community Account, but keep your messages available in the GoDaddy Community in an anonymized form.

6. Content License

You hereby grant GoDaddy a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, combine with other works, display, and perform any Content or feedback that you post on or otherwise provide through the GoDaddy Community.

7. Disclaimer of Representations and Warranties

YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE GoDaddy COMMUNITY SHALL BE AT YOUR OWN RISK AND THAT THE GoDaddy COMMUNITY IS PROVIDED “AS IS”, “AS AVAILABLE” AND “WITH ALL FAULTS”. GoDaddy, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND ALL THIRD PARTY SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, STATUTORY, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. GoDaddy, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE QUALITY, CONTENT AND AVAILABILITY OR FITNESS FOR A SPECIFIC PURPOSE OF THE GoDaddy COMMUNITY, AND GoDaddy ASSUMES NO LIABILITY OR RESPONSIBILITY FOR THE SAME. IN ADDITION, YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT NO ORAL OR WRITTEN INFORMATION OR ADVICE PROVIDED BY GoDaddy, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS (INCLUDING WITHOUT LIMITATION ITS CALL CENTER OR CUSTOMER SERVICE REPRESENTATIVES), AND THIRD PARTY SERVICE PROVIDERS WILL (I) CONSTITUTE LEGAL OR FINANCIAL ADVICE OR (II) CREATE A WARRANTY OF ANY KIND WITH RESPECT TO THE GoDaddy COMMUNITY, AND USERS SHOULD NOT RELY ON ANY SUCH INFORMATION OR ADVICE. THE FOREGOING DISCLAIMER OF REPRESENTATIONS AND WARRANTIES SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW, AND SHALL SURVIVE ANY TERMINATION OR EXPIRATION OF THIS AGREEMENT OR YOUR USE OF THE GoDaddy COMMUNITY.

8. Limitation of Liability

IN NO EVENT SHALL GoDaddy, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND ALL THIRD PARTY SERVICE PROVIDERS, BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING ANY THAT MAY RESULT FROM (I) THE ACCURACY, COMPLETENESS, OR CONTENT OF THE GoDaddy COMMUNITY, (II) THE ACCURACY, COMPLETENESS, OR CONTENT OF ANY SITES LINKED (THROUGH HYPERLINKS, BANNER ADVERTISING OR OTHERWISE) THE GoDaddy COMMUNITY, (III) THIRD-PARTY CONDUCT OF ANY NATURE WHATSOEVER, (IV) ANY VIRUSES, WORMS, BUGS, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR FROM THE GoDaddy COMMUNITY OR ANY SITES LINKED (THROUGH HYPERLINKS, BANNER ADVERTISING OR OTHERWISE) TO THE GoDaddy COMMUNITY, (V) ANY CONTENT THAT IS DEFAMATORY, HARASSING, ABUSIVE, HARMFUL TO MINORS OR ANY PROTECTED CLASS, PORNOGRAPHIC, “X-RATED”, OBSCENE OR OTHERWISE OBJECTIONABLE, AND/OR (VI) ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF THE GoDaddy COMMUNITY, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL OR EQUITABLE THEORY, AND WHETHER OR NOT GoDaddy IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT IN NO EVENT SHALL GoDaddy’S TOTAL AGGREGATE LIABILITY EXCEED $10,000.00 U.S. DOLLARS. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW, AND SHALL SURVIVE ANY TERMINATION OR EXPIRATION OF THIS AGREEMENT OR YOUR USE OF THIS SITE OR THE SERVICES FOUND AT THIS SITE.

9. Indemnity

You agree to protect, defend, indemnify and hold harmless GoDaddy and its officers, directors, employees, agents, and third party service providers from and against any and all claims, demands, costs, expenses, losses, liabilities and damages of every kind and nature (including, without limitation, reasonable attorneys’ fees) imposed upon or incurred by GoDaddy directly or indirectly arising from (i) your use of and access to the GoDaddy Community; (ii) your violation of any provision of these Community Terms or the policies or agreements which are incorporated herein; and/or (iii) your violation of any third-party right, including without limitation any intellectual property or other proprietary right. The indemnification obligations under this section shall survive any termination or expiration of these GoDaddy Terms or your use of the GoDaddy Community.

10. Trademark and/or Copyright Claims

GoDaddy supports the protection of intellectual property. If you would like to submit (i) a trademark claim for violation of a mark on which you hold a valid, registered trademark or service mark, or (ii) a copyright claim for material on which you hold a bona fide copyright, please refer to GoDaddy’s Trademark and/or Copyright Infringement Policy referenced above and available here.

11. Technology Limitations and Modifications

GoDaddy will make reasonable efforts to keep the GoDaddy Community operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. GoDaddy reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the GoDaddy Community or any of its functions and features with or without notice. If GoDaddy modifies or discontinues the GoDaddy Community for any reason, GoDaddy, shall have no liability or responsibility to you.

12. Privacy

GoDaddy cares about your privacy. For this reason, we collect and use personal data only as it might be needed for us to deliver to you our world-class products, services, websites and mobile applications. When you sign up for a use the GoDaddy Community, GoDaddy will only gather, store, share and use your personal data as set forth in the Privacy Policy.

13. Miscellaneous

GoDaddy may change the Guidelines at any time, at its sole discretion. Please do not use the GoDaddy Community if you do not agree to the new Terms.

The Terms are executed in the English language. To the extent any translation of the Terms is provided to you, it is provided for convenience purposes only, and in the event of any conflict between the English and translated version, where permitted by law, the English version will control and prevail.

The Community Terms and Guidelines shall be governed and construed in accordance with the laws of applicable to you pursuant to the GoDaddy Universal Terms of Service Agreement.
